Sedition Charges Against Harinder Singh of SikhRI USA

The government of Punjab has registered Sedition (conduct or speech inciting people to rebel against the authority of a state or monarch) charges against 20 Sarbat Khalsa Organizers. The charges were filed at the Chatiwind police station according to a media report citing Lok Nath Angra IGP of Border Zone.

A day after the Sarbat Khalsa on November 10, the declared Jathedars and several organizers were taken into custody. The charges were registered under Indian Penal Codes 1860 124-A (Sedition) and 153-A.

The following from Punjab were named in the FIR the police filed: Bhai Dhian Singh Mand, Simranjit Singh Mann, Mohkam Singh, Baljit Singh Daduwal, Amrik Singh Ajnala, Gurdip Singh Bhathinda, Satnam Singh Manawana, and Jaskaran Singh Kahn Singh Wala.

Bhai Harinder Singh from Sikh Research Institute of the USA was also named in the FIR. Bhai Harinder Singh is a prominent Sikh scholar whose conducted seminars and conferences throughout the world on Sikh religion.

Other Sikhs named in the FIR were Surjit Singh USA, Resham Singh USA, Gurtej Singh USA, Balwinder Singh Italy and another Singh from UK among those named in FIR.

What does the Draconian Indian Penal Code Say?

124A. Sedition Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards,[a] the Government established by law in India,shall be punished with imprisonment for life, to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.

Explanation 1. — The expression “disaffection” includes disloyalty and all feelings of enmity.
Explanation 2. — Comments expressing disapprobation of the measures of the Government with a view to obtain their alteration by lawful means, without exciting or attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.
Explanation 3. — Comments expressing disapprobation of the administrative or other action of the Government without exciting or attempting to excite hatred, contempt or disaffection, do not constitute an offence under this section.
